Tinejdad – The Moroccan Ministry of Justice and Freedoms posted today on its official website the text of the new Penal Code draft law , which increases the penalties against perpetrators of rape, sexual harassment, and blasphemy.
The draft law defines rape as an act by which a man has sex with a woman against her will, and severely punishes the offender. Anyone charged with raping a minor, elderly, disabled, or a mentally disabled person gets 5 to 10 years of imprisonment and a fine of MAD 20,000 to MAD 200,000.
The draft law increases the sentence when the crime is accompanied by violence. For these crimes, the law stipulates 10 to 20 years of imprisonment and fines ranging from MAD 50,000 to MAD 500,000.
Regarding sexual harassment, the draft law is firm. It stipulates penalties against the authors of letters, photographs, audio or video recordings dubbed sexual or that have sexual purposes. This penalty is doubled if the offense is committed by a colleague in the workplace or persons responsible for ensuring public order or safety in public spaces.
The new draft law also stipulates severe punishments against blasphemy.
Article 219 of the draft law provides for “imprisonment from one year to five years” against anyone guilty of “undermining,” “offending”, or “insulting” God and the prophets by any means.
Article 223 sets a conviction of six months to two years imprisonment for the perpetrators of vandalism of places of worship or sacred religious texts.
