Rabat – The Moroccan Constitutional Court ruled on Wednesday to strip member of the parliament Abdelkader Boussairi of his membership in the House of Representatives.

Abdelkader was removed from his position as the third deputy mayor of the Fez municipality and expelled from the council due to actions deemed contrary to laws and regulations governing public service ethics.

According to Le360, he is being prosecuted for corruption, embezzlement, abuse of power, and misappropriation of public funds, along with 11 others.

The Court’s judgment followed a review of a letter sent by the Speaker of the House of Representatives, recorded on December 20, 2023. The letter forwarded requests for the removal of four members from the council, including Deputy Abdelkader Boussairi, following their dismissal from their appointment responsibilities. 

Documents presented to the Constitutional Court revealed that, on October 6, 2023, the President of the Administrative Court in Fez issued a judicial order officially dismissing Boussairi from his duties as the third deputy mayor and from the municipality council. 

This decision stemmed from his engagement in activities violating existing laws and regulations, as well as compromising the ethical standards of public service.

Boussairi did not appeal against the administrative court’s decision, and after being served notice on November 13, 2023, he was detained at the local prison in Bourkayiz, refraining from challenging the order.

The Constitutional Court has affirmed the conclusive nature of the urgent judicial order that resulted in Boussairi’s removal, necessitating the application of Article 11 of the organizational law related to the House of Representatives. 

With Boussairi stripped of his parliamentary membership, the seat he previously held is now considered to be vacant. 

The court order has called for the initiation of partial elections for the vacant seat in the local electoral district of the Fez Prefecture, following the provisions of Article 91 of the organizational law about the House of Representatives.
