Morocco Cuts Pre-Trial Detention Rate to 30% Threshold

Prosecutors must ensure that detainees appear in court without undue delay and must work closely with presiding judges to process cases within a reasonable timeframe.

Rabat – Morocco has reached an unprecedented milestone in its justice system. 

Pre-trial detainees have made up less than 30% of the total prison population during certain periods, a shift described as historic by the country’s chief public prosecutor.

Prosecutor General Hicham Balaoui issued a circular yesterday with the announcement. 

The directive, addressed to prosecutors across the country, points to improved coordination between the judicial bodies tasked with monitoring pre-trial detention.

According to Balaoui, the work of these local and regional commissions has already produced measurable results. “Morocco managed to reduce pre-trial detention rates to under 30% of the prison population, a level never reached before in previous years,” the circular stated. 

Still, the drop remains fragile. A closer look at data from previous years reveals a recurring rise in pre-trial detention during the summer months. 

Judicial staff shortages during the holiday season often delay hearings and extend detention periods. Balaoui warned of this risk and called for early planning and closer cooperation with court leadership to avoid backlogs and protect public order and individual liberty.

The circular urges a shift in mindset among prosecutors. Pre-trial detention must remain an exception, not a routine measure.

Balaoui called for a responsible and deliberate approach that strengthens trust in the judiciary and protects the progress already made.

He also stressed the need to rely more on legal alternatives and restorative justice, in line with earlier directives. 

Prosecutors must ensure that detainees appear in court without undue delay and must work closely with presiding judges to process cases within a reasonable timeframe.

Balaoui reminded all concerned to follow the files of pre-trial detainees regularly and intervene quickly whenever an obstacle arises. 

He asked prosecutors to apply the circular’s provisions fully and, if difficulties appear, to notify the Public Prosecution headquarters without delay.
