Rabat – Morocco’s Ministry of Justice announced that Law No. 03-23, amending and supplementing the Code of Criminal Procedure, officially entered into force following its publication in the Official Bulletin on September 8.
The ministry described the reform as a pivotal step that reflects the country’s determination to consolidate the rule of law and modernize its judicial system in line with Morocco’s broader transformations.
In a statement, the ministry asserted that the reform responds to Royal Directives calling for a modern penal policy and for ensuring a fair and effective justice system. It also builds on the spirit of the 2011 Constitution, which enshrines the protection of fundamental rights and freedoms as a cornerstone of Morocco’s democratic model.
Reinforcing fair trial guarantees
According to the ministry, the new text introduces stronger safeguards for defendants, consolidates the presumption of innocence, and guarantees the right to a judgment within a reasonable time frame. The law also broadens access to legal aid, reinforcing citizens’ confidence in the justice system.
The provisions tighten oversight of pre-trial detention by limiting its use to strictly necessary cases, requiring judges to justify any incarceration decision, and expanding the use of alternative measures.
The reform also strengthens rights during police custody by requiring suspects to be informed of their rights, granting access to a lawyer, and providing an interpreter when needed.
Expanding victims’ rights
The new law widens protections for victims, ensuring they are kept informed throughout judicial procedures and offered legal and social assistance. Specific provisions address the needs of women and children who are victims of violence. Additionally, the reform creates a National Observatory of Criminality, designed as a scientific tool to guide penal policy based on reliable data.
A pillar of national reform
Justice Minister Abdellatif Ouahbi described the legislation as “a cornerstone of Morocco’s reform project,” stressing that it reflects the state’s confidence in its institutions and its ability to carry out ambitious reforms. He said the law positions Moroccan justice as a regional and international reference point and reinforces the country’s irreversible choice in favor of democracy, the rule of law, and sustainable development.
The minister also detailed that the reform is part of Morocco’s preparations for major national milestones, including the organization of the 2030 FIFA World Cup. A modern judicial framework, he noted, is vital to ensuring legal security and bolstering Morocco’s international draw.
Broader justice overhaul
The adoption of Law No. 03-23 forms part of a wider reform agenda that also includes revising the Penal Code, modernizing legal professions, and accelerating the digital transformation of courts.
The ministry said this long-term project, carried out with consistency and determination, consolidates Morocco’s standing as a pioneer in judicial modernization and supports the vision outlined in the New Development Model for 2030.
