Rabat – Despite international legal challenges, Israel’s ongoing aggression on Gaza remains unimpeded, according to Nambitha Dambuza, South African Supreme Court of Appeal judge.
Speaking on Thursday with AFP, Dambuza highlighted the persistent nature of Israeli Occupation Forces’ (IOF) brutal campaign, even in the face of South Africa’s genocide accusation at the International Court of Justice (ICJ).
South Africa’s case, brought before the ICJ in December 2023, asserts that IOF’s ongoing merciless campaign on Gaza violates the 1948 UN Convention on Genocide. Israel staunchly denied, and continues to deny, these allegations.
“The resolve of the State in question, Israel, is so entrenched that they are convinced of their righteousness and operate with the belief that minimal consequences will follow their actions,” Dambuza stated to AFP.
She elaborated that accountability varies by nation. “Some countries are more receptive to external pressure and modify their behavior accordingly, while others remain largely indifferent,” she argues.
The ICJ, established post-World War II and located in The Hague, adjudicates disputes between nations. Although its rulings are legally binding, the Court lacks enforcement mechanisms.
In a significant ruling on January 26, the ICJ ordered Israel to exert all efforts to prevent acts of genocide in Gaza. Despite this directive, the situation has shown no change.
Since the January ruling, South Africa has repeatedly appealed to the ICJ, citing the worsening humanitarian crisis in Gaza as grounds for immediate intervention. The appeals underscore a pressing need for the Court to implement urgent measures.
Judge Dambuza emphasized the value of bringing such issues to international attention, even if immediate results are not evident.
“Exposing these matters to public scrutiny allows society to witness justice—or attempts at justice. Pressure has indeed been exerted,” she noted.
The ongoing war on Gaza continues to draw global concern. The humanitarian toll, with more than 38,200 Palestinians killed and caused widespread destruction, has prompted numerous calls for ceasefires and negotiations.
